Who has to
Comply?


The POSH Act is all-inclusive, offering coverage to all female employees, regardless of job status—regular, temporary, ad hoc, or contractual. It also protects female interns, apprentices, volunteers, and frequent workplace visitors such as clients or customers. According to Section 4(1) of the POSH Act 2013, every employer is required to create an Internal Complaints Committee at the workplace. In cases where there are many offices, each office must have its own committee.

Filing the annual compliance report is crucial for organizations to demonstrate PoSH compliance and establish effective mechanisms for addressing workplace sexual harassment incidents. The report must be submitted by either the Internal Complaints Committee (for more than 10 employees) or the Local Complaints Committee (for fewer than 10 employees) to the District Officer, outlining the company's PoSH compliance, including the number of cases filed, their resolution, and investigations conducted. In instances where filing the annual report is not mandatory, the employer must still communicate the total number of harassment cases filed in a year to the District Officer.
